Regulations for the provision of electronic services on the Linguido platform
1) General information
The owner of the Linguido platform (hereinafter referred to as the Service Provider), available at the Internet address https://linguido.com, is Linguido sp. Z o.o. with headquarters in Olsztyn at ul. Towarowa 20B, 10-417 entered into the National Court Register by the District Court in Olsztyn, VIII Commercial Department of the National Court Register under the number KRS 0000840230, with share capital of 5,445 PLN, NIP 7393939834, REGON 386014477
2) Technical requirements
Using the platform requires a properly configured computer connected to the Internet. Using some functionalities is also possible using compatible mobile phones and tablets.
To be able to use all the functionalities of the platform, it is necessary:
- end device with access to the Internet and a web browser
- active e-mail account (e-mail),
- cookies enabled.
3) User Accounts
The user of the Linguido platform can be both a natural person and a legal person.
Creating an account on the Linguido platform is free. By creating a new account, the User gains access to the basic functions of the platform and to limited amounts of content available on the platform.
The User undertakes to provide true data in the registration form.
In order to use the platform correctly, the User is obliged to immediately inform the Service Provider of any change in the email address used, by updating the account details on the platform.
For children under 16 years of age, consent to the processing of personal data must be given by a parent or legal guardian.
It is forbidden to set up several accounts by one person, or to share or resale your account to others.
The account name (login) cannot be a word commonly considered offensive, nor hurt anyone's good name. It is not allowed to use the website address as the account name, or inscriptions that are trademarks or that may violate the rights of third parties. Similar restrictions apply to the picture (avatar) assigned to the account.
Information about your account is publicly visible
By registering on the platform, you agree that your account name (login) and basic learning statistics will be displayed on your public profile and on other subpages as part of the Service Provider's websites and applications (e.g. presenting the ranking of the best Users).
By adding your photo to your profile, you agree to publish the image (in the form of a photo) on your public profile on the platform.
Your name, surname and learning statistics are visible to people.
Good morals and security
All actions taken by the User as part of the Service Provider's websites should be in accordance with decency and applicable law. The User undertakes not to provide unlawful content, or to take actions that negatively affect the security or correctness of the functioning of the websites, or harm other Users.
You agree not to attempt to access resources that you do not have permissions for.
It is not allowed to use automated tools sending data to the Service Provider's servers or downloading data from them.
The User undertakes to secure and care for confidential data, such as the account access password.
Links in messages sent to you
For your convenience, links in emails sent to you (including information about promotions, information about your learning progress, information about new materials on the platform, information about your account) may contain parameters that automatically log in to your account. Therefore, do not share the content of these messages with other people.
4) SUBSCRIPTION FEES
Type and scope of services rendered
Initially, our Content can be used for free. This includes initial content and learning courses. If you decide to push your learning forward, we offer various subscription options to best meet your needs. You can choose to purchase our monthly (1 month), quarterly (3 months) or annual subscription (12 months) (each separately referred to as "Plan" and together as "Plans") to access advanced content and courses to learn. Our fees for the above plans can be checked on our website at https://linguido.com/index.php/subskrypcja/ ("Subscription"). Our Fees may change depending on different subscription plans, gift plans and promotions, so we reserve the right to update our Fees from time to time.
If you choose the Monthly Plan, your subscription will automatically extend as a renewable subscription and will be extended at the end of each monthly period, i.e. one month from the day your monthly subscription was activated (or as close to this date as possible). If you choose Quarterly Subscription, your subscription will automatically extend as a renewable subscription and will be extended at the end of each three-month period, i.e. three months from the date on which your Monthly Subscription was activated (or as close to this date as possible). If you choose the Annual Subscription, your subscription will automatically extend as a renewable subscription at the end of each annual period, on the day on which your Annual Subscription was activated (in each case we are talking about "Extension"). If an Extension occurs, the payment method you use to pay the Fees will be used to debit your account at the end of your current subscription.
You understand that if we change the Fees, it will not affect your current Subscription Plan, and therefore if you have purchased a Plan with a specific Fee, no changes to the Fee will affect any current Subscription or Renewals.
You can change your Subscription at any time by going to the "Account" tab on the settings page in your Profile. The changes will have the following effects:
- Change from Monthly Subscription to Quarterly Subscription or Annual Subscription - Your Quarterly Subscription or Annual Subscription will be activated as soon as payment is processed and any time remaining in your Monthly Subscription will be added to your new Subscription.
- Change from Quarterly Subscription to Annual Subscription - Your Annual Subscription will be activated immediately after payment is processed, and any time remaining from your Quarterly Subscription will be added to your new Subscription.
- Change from Annual to Monthly Subscription - Your Annual Subscription will remain active until the remainder of your current Annual Subscription expires and your Monthly Plan will be activated after your Annual Subscription expires.
- Change from Annual Subscription to Quarterly Subscription - Your Annual Subscription will remain active until the remainder of your current Annual Subscription expires and your Quarterly Subscription will be activated after your Annual Subscription expires.
Your subscription can start with a free trial. The length of the free trial period for each subscription is as specified at the time of purchase. Free trial periods cannot be combined with some other specific offers. If you start your subscription with a free trial period, the first day of the billing cycle will be the day after it expires. For example, for a 7-day trial period, the first day of the billing cycle will be Day 8. However, no fees will be charged if you cancel your subscription before the end of your free trial period. You can unsubscribe at any time from your account settings.
Coupons and codes enabling the use of services
Activation codes for access to courses or other services on the platform bought or received free of charge from external suppliers (for example, coupons purchased through group shopping websites or cafeteria systems, codes attached to magazines) can only be implemented on new accounts. New account means an account in which a course subscription or other paid service was not previously active.
In the case of redeeming coupons purchased from external partners, the date of sale is the date of redemption of the coupon in our platform.
5) Intellectual property
Information, data and materials contained on the Service Provider's websites and applications are protected by copyright, trademark rights, database rights or other intellectual property rights.
Content provided by the Service Provider as part of paid courses can only be used by people who have a paid subscription to use paid content or using the platform under a group license.
We reserve the right to periodically update the content of the courses offered, including modifying the content of lessons and exercises provided and removing certain elements.
6) The duration of the contract and the procedure and terms for its termination
Agreement on keeping the User's account on the platform
The agreement on keeping the User's account on our platform is concluded free of charge and is valid for an indefinite period.
The user may at any time stop using the platform and delete the created account by sending an application to us at the email address firstname.lastname@example.org or postal address ul. Towarowa 20B, 10-417 Olsztyn
The Service Provider reserves the right to:
- blocking or deleting a User's account who does not comply with the provisions of these Regulations,
- deletion of a User's account or part of data on the account of a User who has not logged in to the platform for more than 2 years.
The right to withdraw from the contract
The User may withdraw from the contract without giving reasons by submitting a relevant statement in writing within 14 days from the date of the contract. To meet this deadline, it is enough to send before the expiry of the statement of resignation from purchase to the Service Provider's address ul. Towarowa 20B, 10-417 Olsztyn
In the event of withdrawal from the contract, it is considered void. The refund should be made immediately, not later than within fourteen days. The refund will take place via the same form that the payment was made, unless you agree with us on another form of refund implementation.
After the Subscription expires, your learning history is stored for at least two years from the date you last logged in to the platform. So if during this time you decide to pay for the Subscription again, you will be able to continue it without losing the history of previously completed exercises (as long as the elements are still available as part of the ordered service).
Complaints submitted by the Platform User in connection with non-performance or improper performance of services should include:
- name and contact details of the person submitting the complaint,
- the name of the User's account to which the complaint relates,
- subject of the complaint, taking into account the circumstances justifying the claim,
- signature of the person submitting the complaint and date.
The complaint should be sent by e-mail to the e-mail address email@example.com or by post to the address of the Service Provider's registered office.
The answer will be given in the form in which the Service Provider has received the application to the address provided in the application.
The complaint will be considered within 14 days from the date of receipt of the written notification, unless the relevant provisions set a different date.
In special cases, i.e. when the processing of the application requires unusual, special actions and arrangements on the part of the Service Provider or encounters objective obstacles independent and not caused by the Service Provider, the deadline for examining the application may be extended, however not longer than by 14 days.
In a situation in which it is necessary to obtain additional explanations from the User to consider the application, the deadline for responding to the application is further extended by the time of providing explanations by the User.
8) Principles for dealing with complaints and redress
Detailed information on the possibility for the Consumer to use extrajudicial means of dealing with complaints and redress as well as the rules of access to these procedures are available at the headquarters and on the websites of poviat (municipal) consumer ombudsmen, social organizations, whose statutory tasks include consumer protection, Provincial Inspectorates of Inspection Handlowa and at the following internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/spprawy_ind Individualne.php and http://www.uokik.gov.pl/wazne_adresy.php.
The consumer has the following examples of options for using out-of-court complaint handling and redress:
The consumer is entitled to apply to a permanent amicable consumer court referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to resolve the dispute arising from the Agreement concluded with the Seller.
The consumer is entitled to apply to the provincial inspector of Trade Inspection, in accordance with art. 36 of the Act of December 15, 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.
The consumer may obtain free assistance in resolving the dispute between him and the Seller, also using the free assistance of the poviat (municipal) consumer ombudsman or social organization, whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).
9) Final provisions
The Service Provider reserves the right to make changes to these Regulations, in accordance with the relevant legal regulations. In the event of significant changes in the Regulations, the Service Provider will notify Users by sending a notification to the e-mail address associated with the account on the platform and / or in the form of a system message on the platform.
Changes in the regulations become effective within 7 days of informing the User about them. In the absence of acceptance by the User of changes introduced in the Regulations, the User in order to terminate the contract should immediately notify the Service Provider.
Polish law is applicable to all legal relations arising from these Regulations.
In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; Act on the provision of electronic services; Consumer Rights Act, Personal Data Protection Act.
The customer has the right to use extrajudicial means of dealing with complaints and redress. To this end, he may file a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
